1. Acceptance of Terms
1.1 Binding Agreement
By downloading, accessing, or using the EZHouse mobile application, website, or related services (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not use the Service.
1.2 Modifications
We may revise these Terms from time to time. Updated versions will be made available within the application or on our website. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
1.3 Cost of Service
EZHouse currently provides its core features free of charge. We do not presently offer paid features, subscriptions, or in-app purchases. You remain responsible for any carrier, internet, or mobile device charges incurred while using the Service.
1.4 Privacy Policy
Your use of EZHouse is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
2. Definitions
- User — Any individual who accesses or registers an account on EZHouse.
- Rent Provider — A user who lists rental property on the platform.
- Tenant — A user searching for rental accommodation.
- User Content — Text, images, listings, preferences, chats, and other information submitted by users.
3. Accounts, OTP Verification & Registration
3.1 Registration and Mobile Login
Access to the Service requires authentication using your mobile phone number and a One-Time Password (OTP). You are responsible for maintaining control of your account and all activities performed using it.
3.2 Preferences
Users may optionally provide housing preferences to improve property matching. You agree that any information you provide is accurate and kept reasonably up to date.
3.3 Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements to use the Service.
4. App Features & User Personas
EZHouse operates as a two-sided rental marketplace that connects Rent Providers and Tenants.
4.1 Rent Providers
Rent Providers may publish rental listings containing descriptions, pricing, photographs, amenities, and tenant preferences.
Rent Providers are solely responsible for ensuring that their listings are accurate, lawful, and up to date.
4.2 Tenants
Tenants may browse available properties, apply filters, review amenities, and communicate with Rent Providers.
4.3 Universal Features
All registered users may maintain wishlists, communicate using in-app chat, log out, and permanently delete their account.
5. Device Permissions and Location Details
5.1 Location Requirements
EZHouse requires access to your device's location services to display nearby rental properties, provide map functionality, and improve the relevance of search results.
If you deny or disable location permissions, certain features of the Service may not function correctly or may provide less accurate results.
5.2 Media Access
Rent Providers must grant access to the device camera and photo library or storage to upload images of rental properties. These permissions are used solely to enable the property listing features of the Service.
6. User Conduct and Prohibited Uses
By using EZHouse, you agree that you will not:
- Publish fraudulent, misleading, outdated, or unauthorized property listings.
- Misrepresent your identity, profession, relationship status, or ownership of any listed property.
- Harass, threaten, abuse, stalk, intimidate, or discriminate against another user through listings or chat messages.
- Send spam, unsolicited advertising, commercial promotions, malicious software, or phishing content.
- Copy, scrape, index, or reproduce property listings, photographs, or user information without prior written permission.
- Use the Service for unlawful purposes or in violation of applicable housing, rental, or other laws.
7. User Content and Platform Interactions
7.1 Ownership and License
You retain ownership of all User Content that you upload, including property descriptions, photographs, chat messages, and other information.
By publishing User Content through EZHouse, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, distribute, and use that content solely for operating, maintaining, and improving the Service.
You represent and warrant that you own or otherwise have all necessary rights and permissions to upload the User Content you submit.
7.2 In-App Chat and Offline Transactions
EZHouse provides communication tools to connect Rent Providers and Tenants but acts solely as an intermediary technology platform.
We do not guarantee the accuracy, legality, quality, completeness, or safety of any property listing, user profile, or communication.
Any lease agreement, payment, property inspection, or other offline interaction occurs solely between the users involved and is undertaken entirely at their own discretion and risk.
8. Intellectual Property
Except for User Content, all content made available through EZHouse—including the software, logos, trademarks, graphics, icons, text, designs, and other materials—is owned by or licensed to EZHouse and is protected by applicable intellectual property laws.
You may not copy, modify, reproduce, distribute, reverse engineer, create derivative works from, or otherwise exploit any part of the Service without our prior written permission.
9. Account Deletion and Termination
9.1 Account Deletion
You may log out of your account or permanently delete your account at any time using the options available within the EZHouse application.
Upon account deletion, your personal information will be deleted or anonymized in accordance with our Privacy Policy, except where we are required to retain certain information by applicable law.
9.2 Platform Termination
We reserve the right to suspend, restrict, or permanently terminate your access to the Service without prior notice if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or acted in a manner that harms the Service or its users.
Termination of your account does not affect provisions of these Terms that are intended to survive termination, including intellectual property rights, disclaimers, limitation of liability, indemnification, and governing law.
10. Service Availability, Disclaimer of Warranties & Limitation of Liability
10.1 "As-Is" Service
EZHouse is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or free from defects.
10.2 Maintenance
We may temporarily suspend or limit access to the Service for maintenance, upgrades, security improvements, or operational reasons without prior notice.
10.3 Force Majeure
We shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, internet outages, government actions, labor disputes, cyberattacks, or failures of third-party services.
10.4 Disclaimer of Liability
To the maximum extent permitted by applicable law, EZHouse, its owners, developers, affiliates, and contributors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Examples include, but are not limited to:
- Inaccurate, misleading, or fraudulent property listings submitted by users.
- Disputes, damages, financial losses, or behavioral issues arising from offline landlord-tenant interactions.
- Data loss, service interruptions, delays, or temporary unavailability of the platform.
11. Indemnification
You agree to defend, indemnify, and hold harmless EZHouse, its developers, affiliates, and representatives from and against any claims, liabilities, damages, losses, expenses, or reasonable legal fees arising out of:
- Your violation of these Terms.
- Your misuse of the Service.
- Your interactions with other users.
- Any User Content or property listings you publish.
12. Governing Law
These Terms of Use shall be governed by and interpreted in accordance with the laws of India, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts located in Raipur, Chhattisgarh, India.
